The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 29 May 2024 beginning at 10:00 a.m. The Mayor, Mark Sutcliffe, presided over the meeting from Council Chambers with some Members attending in person and the remaining Members participating remotely by Zoom.

Mayor Sutcliffe led Council in a moment of reflection.

Approve leveraging the administration of the Yellow Bag Program to accommodate households exceeding three garbage items on any given garbage collection week, based on direction from City Council on June 14, 2023 through Motion no. 2023-16-06, and following consultation with the Solid Waste Planning Council Sponsor’s Group;
    3. Direct staff to consult with property owners and delegates to explore tailored approaches to mitigate enforcement challenges faced by collections staff for properties with common pad collection and properties with two or more units receiving curbside waste collection services and delegate the authority to staff to take the steps necessary to pilot tailored approaches with willing owners, as outlined in the report, and report back to Council on progress in 2025; and,
    4. Receive the results of the Third-Party Review of data used to inform the Curbside Waste Diversion Policy report, appended as Document 1.

    2. Authorize the financial allocation of the City’s Major Active Transportation Structures Program budget to be used to reimburse the Province of Ontario up to a maximum amount of $5,403,185.84 (includes sunk HST) for the construction of these cycling facilities, as described in the report.

That once sufficient revenue from temporary construction encroachment fees, and other funds has been received to commence the project, a new internal account will be set up for the design and implementation of enhanced public realm improvements in and around Somerset Square with funding from the temporary construction encroachment fees to be limited to expenditures on lands within the right-of-way; and
    3. That at the conclusion of these works any residual temporary construction encroachment revenue in the internal order be returned to Planning, Real Estate and Economic Development Department general revenues.

    WHEREAS the motion ACS2024-OCC-CCS-0039 was carried at Transportation Committee on May 23 2024; and

    WHEREAS the motion included that subsequent Council approval will be required to confirm the redirection of the Section 37 funds; and

    WHEREAS, in accordance with Minutes of Settlement signed on October 20, 2022 in respect of OPA 264 and Zoning By-law 2021-341 for 26, 36 and 40 Armstrong Street and 961, 967, 969, 973 and 979 Wellington Street West, City staff agreed to recommend that the $250,000 being provided by the developer in funds pursuant to the former Planning Act, s. 37, be redirected towards the improvement of Somerset Square through a Section 37 agreement; and

    WHEREAS Council approval is required to confirm the redirection of the Section 37 funds;

    THEREFORE BE IT RESOLVED that Council approve the redirection of the funds from the Section 37 agreement, in the amount of $250,000, into the deferred revenue account, along with the estimated $550,000 in temporary encroachment fees, to fund the design and implementation of enhanced public realm improvements.

    WHEREAS Bank Street is designated as a Traditional Mainstreet in the Official Plan (OP), and this designation is among the OP's intensification target areas and Design Priority Areas, and

    WHEREAS the City is undertaking a full integrated renewal of Bank Street (From Old Ottawa South, Billings Bridge, Riverside to Walkley Road), including underground infrastructure and utilities and this represents a once in 75 year opportunity to achieve economies of scale; and 

    WHEREAS Bank Street (Riverside to Ledbury) is a mixed-use area with significant development potential, businesses, transit stops, and is being re-designed to better facilitate pedestrian activity, traffic safety, and bicycling; and 

    WHEREAS the required five-metre development setback from overhead hydro lines translates into a loss of development potential in some areas and therefore a loss of development-related revenue and foregone taxable property assessment potential;

    WHEREAS there are currently new developments that are being planned for 1330, 1335, 1400 Bank and other areas that could benefit from buried hydro wires, making this an opportune moment for burial;

    WHEREAS there is more intensification that has been revealed through the comprehensive zoning bylaw update planned along Bank Street and significant business frontages on this corridor;

    WHEREAS this proposed hydro burial would comply with direction in the New Official Plan;

    WHEREAS the additional cost for hydro burial will be an additional future capital project ask, subject to Council approval;

    WHEREAS opportunities for resilience in the grid don’t come along often and Ottawa has been seeing more wind storms, power outages, and repairs required;

    THEREFORE BE IT RESOLVED THAT Council requests staff to investigate and include Hydro wire burial along select sections of Bank Street in the renewal area subject to project scope, estimates and funding to be confirmed.

    WHEREAS the undergrounding of hydro poles continues to be an ongoing discussion for many corridors in the city; and

    WHEREAS full scale renewal projects provide an opportunity for the City to improve the public realm, unlock barriers for well-designed and intensified development on the main streets of our design priority areas, and undertake climate change adaptation for our infrastructure; and

    WHEREAS Ottawa has been seeing more windstorms and power outages which can require repairs to its electrical grid; and

    WHEREAS Hydro Ottawa has completed their asset management plans that identify areas where resiliency or grid capacity projects may be required, and opportunities for implementation through City integrated projects should be considered and coordinated;

    WHEREAS the City is continuing work on a revised hydro burial policy that considers hydro grid resiliency, design priority areas, development potential, transportation safety and modal share, with an affordability lens based on outcomes of the asset management plans and long-term sustainability in mind;

    THEREFORE BE IT RESOLVED THAT Council requests staff consider Hydro Ottawa’s resiliency and system capacity planning objectives in determining whether to include full or partial hydro burial in future integrated projects planned in design priority areas as set out in the Official Plan (OP);

    THEREFORE BE IT RESOLVED THAT Council direct staff to give due consideration to affordability determined through approval of the asset management plans and long range financial plans in future update of the City’s Hydro Burial Policy.

    WHEREAS the participation rates of Canadians engaging in healthy physical activities has declined, while inactivity and obesity continues to rise in Canada; and

    WHEREAS health and fitness ought to be promoted and embraced by Canadians of all ages and abilities; and

    WHEREAS many Canadian cities have taken up the annual challenge of encouraging and promoting physical activity, including Calgary, Saskatoon, Montréal and Victoria; and

    WHEREAS the City of Ottawa offers a multitude of recreation and leisure programming and promotes active and healthy living through a number of initiatives; and

    WHEREAS the City of Ottawa has previously offered incentives to residents to embrace physical activity and fitness in recognition of past National Health and Fitness Days; and

    WHEREAS Ottawa Public Health has indicated that staying active is a positive coping strategy to taking care of your mental health; and 

    WHEREAS the City of Ottawa Departments (Ottawa Public Health, Recreation, Cultural and Facility Services Department and others) work together on improving access to and encouraging physical activity for residents; and

    WHEREAS the City of Ottawa encourages residents to get outside and enjoy outdoor amenities such as parks, hiking and bike trails, courts, and skateboard parks; and

    WHEREAS The City of Ottawa has a “Play Free” initiative offering a selection of free drop-in programming for children and youth; and

    WHEREAS the City of Ottawa wishes to encourage all residents to embrace physical activity and fitness by participating in Free Play activities, as well as a free virtual Zumba class on Saturday, June 1, 2024 in recognition of 2024 National Health and Fitness Day; 

    THEREFORE BE IT RESOLVED that City Council declare Saturday, June 1, 2024 to be National Health & Fitness day in Ottawa.

    WHEREAS 2024 is the 100th anniversary of the Royal Canadian Air Force (RCAF);

    WHEREAS the RCAF has helped preserve the freedoms of all Canadians, contributed to global peace and security, and to helped those in need in Canada and abroad; and

    WHEREAS the RCAF provides air defence, maritime patrol, search and rescue, air mobility and sustainment, aerospace control, and space capabilities to support operations at home and abroad; and

    WHEREAS the RCAF is a respected military partner worldwide, providing security at home through NORAD and working with our NATO allies and partners to maintain peace and stability across the globe; and

    WHEREAS the City of Ottawa has been the location of important RCAF operations including CFB Rockcliffe, CFB Uplands, CFS Leitrim and other RCAF activities; and

    WHEREAS RCAF aircraft and the RCAF aeronautical team Snowbirds have been a central and iconic feature of Ottawa’s Canada Day celebrations; and

    WHEREAS the RCAF, as a national institution, has played a role in shaping Ottawa as a City, and forged its own place in the local story; and

    WHEREAS it is fitting for the National Capital to commemorate the 100th Anniversary of the RCAF; and

    WHEREAS the City Archivist has access to a collection of local RCAF artifacts and photographs, an annual budget for important public displays, and supports commemorating the 100th Anniversary of the RCAF; and

    WHEREAS the Ottawa Public Library has a collection of RCAF historical reading material;

    THEREFORE BE IT RESOLVED the City Archivist develop and make available a temporary public display at Ottawa City Hall to commemorate the 100th anniversary as part of their 2024 annual programming; and

    BE IT FURTHER RESOLVED that a tree be planted in Claudette Cain Park in Riverside South as part of the planned 2024 tree planting program to commemorate the RCAF’s 100th anniversary and that an appropriate plaque be installed to commemorate this event with all costs related to the production and installation of the plaque be funded through the Ward 22 constituency services budget; and

    BE IT FURTHER RESOLVED that City Council request that the Ottawa Public Library Board consider publishing and promoting a curated list of RCAF readings or other media in both official languages from the library collection.

    WHEREAS the Ontario Building Code was amended on February 28, 2023, requiring building permit applications for demountable stages and associated sound and lighting equipment towers, as further prescribed by Regulation 30/23; and

    WHEREAS local not-for-profit community fundraisers and not-for-profit Canada Day community events are now required to obtain a permit for their demountable stages; and

    WHEREAS the costs associated with this new requirement has an impact on not-for-profit and community organizations, and local organizations have requested an exemption from the building permit fees established by the City’s Building By-law 2014-220, as amended, which are currently $11.30 per square foot value of the construction with a minimum cost of $103;

    THEREFORE BE IT RESOLVED that City Council delegate the authority to the Chief Building Official to waive building permit application fees established by the City’s Building By-law 2014-220, as amended, for not-for-profit permit applicants who apply for a demountable stage permit as required by the Building Code Regulation 30/23 for their fundraising event.

    WHEREAS the Bytown Fire Brigade is a non-profit Ottawa-based organization established in 1983 to serve the community as a local historical society with a mission to collect, preserve, conserve, restore and display the artifacts and apparatus that tell the history of firefighting in Canada's capital and the country as a whole; and 

    WHEREAS the Bytown Fire Brigade has expressed an interest in strengthening its relationship with the City of Ottawa for the purposes of building capacity and expanding its community reach; and

    WHEREAS the City of Ottawa operates several cultural programs, including City-owned museums and historic sites, along with various forms of cultural funding through museum service agreements, heritage service agreements, and the heritage funding program, including project funding, annual operating funding, multi-year operating funding; and 

    WHEREAS the City Archives maintains its own partnership agreements and other relationships, including those with the Friends of the City of Ottawa Archives, historical societies, religious organizations, and individual volunteers; 

    WHEREAS the City Archives, as part of its mandate, acquires and makes available city and community records, including those of first responders, such as Ottawa Fire Services; 

    THEREFORE BE IT RESOLVED that the City Clerk and General Manager, Recreation, Cultural, and Facility Services be directed to engage with the Bytown Fire Brigade to explore various options for strengthening the City’s relationship with the Bytown Fire Brigade and to identify ways that the City may assist them building capacity and reach for their community work.

    Whereas it is desirable that the applicable date for the transitional rates for development charges under By-law 2024-218, Schedules B and C be clarified before such transitional rates would come into effect;

    Therefore Be It Resolved that the Rules of Procedure Be Suspended to permit the introduction of the following motion;

    WHEREAS it was intended through Planning and Housing Committee Motion 2024-27-01, adopted through Council Item 14.1 adopted on May 15, 2024 that the Transitional Rate for Schedules B and C be the development charges rate in effect on the day prior to the enactment of the new by-law; and

    WHEREAS Planning and Housing Motion 2024-27-01 inadvertently stated the date of May 21, 2024 when the correct date to be utilized was May 14, 2024; and

    WHEREAS, although the enacted by-law, subsection 12(4) did state the correct date of May 14, 2024, such was not in PHC Motion 2024-27-01 and it is desirable to expressly provide Council authority for such date;

    THEREFORE BE IT RESOLVED that a by-law be added to the agenda of the May 29, 2024 meeting of Council to provide that By-law 2024-218, subsection 12(4) be repealed and re-enacted such that it will continue to read in accordance with the following:


    12(4)     For the period from seven calendar days after the repeal of the Development Charges Act, subsection 5(6), paragraph 4 to and including August 16, 2024, in respect of any applicant for a building permit to which the Development Charges Act, subclause 26.2(1 )(c) applies, the applicable development charges will be calculated according to the development charge rates in effect on May 14, 2024


    BE IT FURTHER RESOLVED That pursuant to the Development Charges Act, subsection 12(3), it is determined that no further public notice is necessary.

    WHEREAS The Orléans Craft Beer Festival is an outdoor festival promoting traditional, exotic and different worlds of beer, wine, spirits and street foods, featuring multiple food vendors, breweries and live entertainment; and

    WHEREAS The Orléans Craft Beer Festival is to occur on Friday, June 7, 2024 through Sunday, June 9, 2024; and

    WHEREAS Centrum Boulevard from Brisebois Crescent to Prestone Drive is required to be closed to accommodate the festival and on-street festival set-up; and

    WHEREAS the on-street festival set-up will commence at 7:00 a.m. on Friday, June 7, 2024 and the festival will begin operation at 5:00 p.m. on Friday, June 7, 2024; and

    WHEREAS the on-street festival take-down will commence at 8:00 a.m. on Sunday, June 9, 2024 and continue until 11 p.m.  on Sunday, June 9, 2024; and

    WHEREAS the City of Ottawa’s Special Events on City Streets By-law (2001-260) prohibits road closures before 6:00 p.m. Monday to Friday; 

    THEREFORE BE IT RESOLVED that Council approve the road closure for Centrum Boulevard from Brisebois Crescent to Prestone Drive from 7:00 a.m. on Friday, June 7, 2024 to 11 p.m. on Sunday, June 9, 2024 for the Orléans Craft Beer Festival, providing it meets the requirements, conditions and approval of Special Events Advisory Team (SEAT).

    WHEREAS Chinese Cuisine & Hospitality Association of Canada will host the annual Ottawa Chinatown Night Market event; and

    WHEREAS many of the Ottawa Chinatown Night Market activities will be happening outdoors on Somerset Street between Bronson Avenue and Bell Street North. Activities consist of an outdoor food festival to bring fun to the community with food tastings and cultural/musical performances; and

    WHEREAS The Ottawa Chinatown Night Market is to occur on Friday, May 31, 2024, through Sunday, June 2, 2024; and

    WHEREAS Somerset Street from Bronson Avenue to Bell Street North is required to be closed to accommodate the festival and on-street festival set-up; and

    WHEREAS the on-street festival set-up will commence at 8:00 p.m. on Thursday, May 30, 2024, and the festival will begin operation at 2:00 p.m. on Friday, May 31, 2024; and

    WHEREAS the on-street festival take-down will commence at 8:00 p.m. on Sunday, June 2, 2024, and continue until 11 p.m. on Sunday, June 2, 2024; and

    WHEREAS the City of Ottawa’s Special Events on City Streets By-law (2001-260) prohibits road closures before 6:00 p.m. Monday to Friday; 

    THEREFORE BE IT RESOLVED that Council approve the road closure for Somerset Street from Bronson Avenue to Bell Street North from 8:00 p.m. on Thursday, May 30, 2024 to 11 p.m. on Sunday, June 2, 2024 for the Ottawa Chinatown Night Market, providing it meets the requirements, conditions and approval of Special Events Advisory Team (SEAT).

These markets often feature live music, entertainment, and a lively atmosphere, attracting locals and visitors alike; and

    WHEREAS The Parkdale Night Market is to occur on every Wednesday starting Wednesday, June 5, 2024, through to Wednesday, October 9, 2024; and
