STATEMENT READ BY ARAC CHAIR TO
PUBLIC
AT BEGINNING OF A “MEETING TO
CONSIDER” AN ENGINEER’S REPORT
“This
meeting is being held pursuant to Section 42 of the Drainage Act and is only
for the purpose of considering the Engineer’s report and associated By-law,
and to receive any written submissions with respect to the technical aspect
of the construction of the drainage works”.
Consideration
of appeals to assessments by landowners will be heard by the Court of
Revision at another time, yet to be determined. All assessed landowners will
be provided with written notice of the time and place of the convening of the
Court of Revision, and will be provided with an opportunity to file an appeal
their assessment by submitting it in writing to the Clerk.
Anyone
wishing to submit written comments on the technical merits of the Engineer’s
report only is encouraged to do so by providing the details to the Committee
Assistant.”
Mr.
David Ryan, Project Manager, Municipal Drainage stated that he had received
no appeals.
That the members of the Agriculture and Rural Affairs
Committee, in their role as members of the Court of Revision, convene for the
first sitting of the Court of Revision under Subsection 46(3) of the Drainage
Act immediately following the meeting of the City’s Agriculture and Rural
Affairs Committee on June 25, 2012 for the purpose of hearing appeals under
Section 52 of the Drainage Act of landowners whose lands have been assessed
in the Engineer’s Report For The Improvement of the South Cyrville Municipal
Drain dated February 2012.
