That the Rules of Procedure be suspended to consider the following Motion to request an amendment to the Official Plan Adjustments Act, 2023 prior to the Provincial Legislature resuming its session on February 20, 2024
WHEREAS the Minister of Municipal Affairs and Housing on November 4, 2022 made a decision to approve, with modifications, the new Official Plan of the City of Ottawa, adopted by By-law 2021-386; and
WHEREAS Ministerial Modification 20 in deleting and replacing Scheduled B9 added approximately 41 ha to the village of Greely; and
WHEREAS Ministerial Modifications 21 to 27 amended various C-schedules to Volume 1 to reflect the revised boundary of the village of Greely; and
WHEREAS on September 13, 2023, City Council adopted by By-law 2023-403 Official Plan Amendment 5 which included updates to implement amendments made to the Official Plan made by the Minister of Municipal Affairs and Housing; and
WHEREAS amendment 66 in OPA 5 provided for the following in respect of the land added to Greely by Ministerial Modification 20:
Update the designation on lands added to the village by the Minister of Municipal Affairs and Housing:
• on OP schedules (e.g. B9) to ‘Village’ and
• the Village of Greely Secondary Plan schedule to ‘Village Residential’
AND WHEREAS OPA 5 was not appealed to the Ontario Land Tribunal and thus came into force on at the expiration of its appeal period; and
WHEREAS the Official Plan Adjustments Act, 2023, in force as of December 6, 2023, deemed the Official Plan of the City of Ottawa to have been approved without any modifications, thereby repealing Ministerial Modifications 20 to 27 retroactive to November 4, 2022, in respect of the village of Greely; and
WHEREAS it is desirable to have the status of Modification 66 in OPA 5 legislatively clarified.
THEREFORE BE IT RESOLVED that the Minister of Municipal Affairs and Housing be requested to introduce legislation before the Legislative Assembly of Ontario at the earliest opportunity that would include the deeming of Modification 66 to Official Plan Amendment 5 to never have come into force.
