Call to order and moment of reflection

The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 7 February 2024 beginning at 10:00 a.m. The Mayor, Mark Sutcliffe, presided over the meeting from Council Chambers with some Members attending in person and the remaining Members participating remotely by Zoom.

Mayor Sutcliffe led Council in a moment of reflection.

Mayor Sutcliffe along with Councillor King, Council Liaison for Anti-Racism and Ethnocultural Relations, spoke to February being Black History Month. The 2024 theme for Black History Month is: “Black Excellence: A Heritage to Celebrate; a Future to Build”. This theme celebrates the rich past and present contributions and accomplishments of Black people in Canada, while aspiring to embrace new opportunities for the future.

Motion – Developing a Rural ASE Strategy

  1. Direct staff to undertake a pilot study to ascertain the efficacy of automated speed enforcement (ASE) cameras as a road safety improvement in Ottawa’s rural villages; and
  2. Approve that the baseline data be collected for site selection in 2024; and 
  3. Approve that, following the collection of baseline data, staff be directed to return to ARAC with recommended pilot sites to be included in the 2025 ASE implementation list; and
  4. Approve that as with the original pilot study, the concurrence of the Ward Councillor be a requirement for ASE sites selected for this pilot study; and
  5. Direct staff to report back to the Agriculture and Rural Affairs Committee on the results of this pilot study as soon as practicable.

Social and Economic Prosperity Review

  WHEREAS nearly a third of municipal spending in Ontario is for services in areas of provincial responsibility and expenditures are outpacing provincial contributions by nearly $4 billion a year; and

  WHEREAS municipal revenues, such as property taxes, do not grow with the economy or inflation; and

  WHEREAS unprecedented population and housing growth will require significant investments in municipal infrastructure; and

  WHEREAS municipalities are being asked to take on complex health and social challenges – like homelessness, supporting asylum seekers and addressing the mental health and addictions crises; and

  WHEREAS inflation, rising interest rates, and provincial policy decisions are sharply constraining municipal fiscal capacity; and

  WHEREAS property taxpayers – including people on fixed incomes and small businesses – can’t afford to subsidize income re-distribution programs for those most in need; and

  WHEREAS the Province of Ontario can, and should, invest more in the prosperity of communities; and

  WHEREAS municipalities and the provincial government have a strong history of collaboration;

  THEREFORE BE IT RESOLVED that the Mayor, on behalf of City Council, be directed to write to the provincial Minister of Finance to encourage the Province of Ontario, in collaboration with the Association of Municipalities of Ontario, to undertake a comprehensive social and economic prosperity review to promote the stability and sustainability of municipal finances across Ontario.

Police Services Board Chair Compensation

  WHEREAS the Ottawa Police Services Board (the “Board”) is comprised of the Mayor, two Members of Council, three provincially-appointed members and a Council-appointed public member, in accordance with the Police Services Act; 

  WHEREAS on December 7, 2022, Council approved Motion 2022 - 03/21 to provide an increase in the honorarium for a Public Member of the Ottawa Police Services Board who is elected as Chair to $54,000, to be funded from the existing honorarium and the Council Administration budget credit that would otherwise go to the Constituency Services Budget of a Member of Council who is elected as Chair of the Board; and

  WHEREAS the Council-appointed public member who served as Chair of the Board unexpectedly resigned in December, 2023 and a recruitment process is now underway to fill the vacant Council-appointed public member position; and 

  WHEREAS the Board is required to elect a Chair and Vice Chair at its first meeting of each calendar year, in accordance with the Police Services Act as well as the Board’s Procedure Bylaw, and 

  WHEREAS at its January 22, 2024, meeting, the Ottawa Police Services Board (Board) elected one of the provincially appointed members, Salim Fakirani, as Chair; and

  WHEREAS Motion 2022 - 03/21 approved in December, 2022 applies only to a Council-appointed public member elected as Chair; and

  WHEREAS the position of Chair of the Police Services Board is one of significant responsibility, requiring a substantial personal commitment of time and resources; 

  THEREFORE BE IT RESOLVED that eligibility for the enhanced honorarium provided to a Council-appointed public member serving as Chair of the Ottawa Police Services Board be extended to the provincially-appointed Members, effective upon that member’s appointment as Chair of the Board.

Motions Requiring Suspension of the Rules of Procedure

18.1

Timeline for Reporting Back on Voluntary Donations Per Motion 2024 – 29-05.

  That the Rules of Procedure be suspended to consider the following motion as City Council has received new information indicating the need for a policy update as soon as possible.

  WHEREAS on January 24, 2024, City Council considered the report titled, “Motion – Memorandum of Understanding with Katasa Group,” and approved authorizing the City of Ottawa to enter into a Memorandum of Understanding (MOU) with Katasa Group for the purposes of realizing two voluntary contributions, as amended by the following motions:

  •    Motion No. 2024 – 29-05, which provided, “That an updated policy framework for voluntary donations for community benefits be developed in order to ensure consistency of approach and application, to improve transparency, with a prescribed delegated of authority for the allocation of resources and that the policy include a toolkit and scripts to help bring uniformity and clarity to these discussions for all parties,” and, “That public consultation including the development industry and the Minister of Municipal Affairs and Housing be included and that this policy be presented as part of mid-term governance report for Council’s consideration,” and
  •    Motion No. 2024 – 29-06, which provided, in part, “that until such time as Council considers a new Policy Framework for voluntary contributions through the Mid-Term governance report, any future voluntary donation agreements with developers that may come forward be allocated on a City-wide basis under delegated authority of the respective General Manager”; and

  WHEREAS on January 29, 2024, Katasa Group issued a statement indicating it would no longer provide the contributions as contemplated, citing in part that the process with respect to voluntary contributions was unclear; and

  WHEREAS the Katasa Group statement highlights the need for the updated policy framework described in Motion No. 2024 – 29-05 to be in place as soon as possible to provide transparency and clarity regarding any future voluntary donation agreements with developers;

  THEREFORE BE IT RESOLVED that the timeline for developing an updated policy framework for voluntary donations for community benefits, as approved by City Council through Motion No. 2024 – 29-05 and including consultation as described in this motion, be amended such that the policy is brought forward for consideration by Finance and Corporate Services Committee and Council no later than July 2024.

  That the Rules of Procedure be suspended to consider the following Motion to  request an amendment to the Official Plan Adjustments Act, 2023 prior to the Provincial Legislature resuming its session on February 20, 2024

  WHEREAS the Minister of Municipal Affairs and Housing on November 4, 2022 made a decision to approve, with modifications, the new Official Plan of the City of Ottawa, adopted by By-law 2021-386; and

  WHEREAS Ministerial Modification 20 in deleting and replacing Scheduled B9 added approximately 41 ha to the village of Greely; and

  WHEREAS Ministerial Modifications 21 to 27 amended various C-schedules to Volume 1 to reflect the revised boundary of the village of Greely; and

  WHEREAS on September 13, 2023, City Council adopted by By-law 2023-403 Official Plan Amendment 5 which included updates to implement amendments made to the Official Plan made by the Minister of Municipal Affairs and Housing; and

  WHEREAS amendment 66 in OPA 5 provided for the following in respect of the land added to Greely by Ministerial Modification 20:

  Update the designation on lands added to the village by the Minister of Municipal Affairs and Housing:
  •    on OP schedules (e.g. B9) to ‘Village’ and
  •    the Village of Greely Secondary Plan schedule to ‘Village Residential’

  AND WHEREAS OPA 5 was not appealed to the Ontario Land Tribunal and thus came into force on at the expiration of its appeal period; and

  WHEREAS the Official Plan Adjustments Act, 2023, in force as of December 6, 2023, deemed the Official Plan of the City of Ottawa to have been approved without any modifications, thereby repealing Ministerial Modifications 20 to 27 retroactive to November 4, 2022, in respect of the village of Greely; and

  WHEREAS it is desirable to have the status of Modification 66 in OPA 5 legislatively clarified.

  THEREFORE BE IT RESOLVED that the Minister of Municipal Affairs and Housing be requested to introduce legislation before the Legislative Assembly of Ontario at the earliest opportunity that would include the deeming of Modification 66 to Official Plan Amendment 5 to never have come into force.

Ditch Alteration Policy Council Sponsor Group

  WHEREAS at the end of the last Term of Council, Council approved the establishment of a Ditch Alteration and Maintenance Sponsors Group to act as a sounding board and to work with staff to oversee the implementation of the Ditch Alteration Policy, including a public consultation and education plan; 

  THEREFORE BE IT RESOLVED That Council approve the re-establishment of the Ditch Alteration and Maintenance Sponsors Group for the 2022-2026 Term of Council to be comprised of up to six (6) members of Council at large; and
  BE IT FURTHER RESOLVED THAT the Office of the City Clerk circulate a request for interest for participation in the Sponsors Group with the intent of appointing members to the Sponsors Group at the next regular Council meeting; and

  BE IT FURTHER RESOLVED THAT a timeline with key milestones be identified when the terms of reference for the Sponsors Group are created.

Patro Programming

  WHEREAS the P’tit Bonheur program is not allocated any funding anymore following the decision of the Patro not to offer any longer any programming at 40 Cobourg Street; and

  WHEREAS the P’tit Bonheur program is one of the only day programs for Francophone adults with special needs; and

  WHEREAS there is no other program that provides an essential support to families with special needs;

  THEREFORE BE IT RESOLVED THAT the City of Ottawa take all necessary measures to ensure the program is offered directly or indirectly and to a certain extent by a third-party provider; and

  BE IT FURTHER RESOLVED that the Renewable Recreation Funding previously allocated to Patro to support community programming be made available under Delegated Authority to the General Manager of Recreation, Culture and Facility Services in order for the City to deliver programs similar to those lost by Patro’s suspension of operations, including the P’tit Bonheur program.

S. Desroches - Building Permit Processes and Costs

In January of 2024, the Canadian Federation of Independent Business released a comparative analysis and report on the cost and permitting process for home renovations by Canadian municipalities

What is the City of Ottawa doing to reduce the “red tape” for building permit applicants and ensure that the permitting process is efficient including low permit fees and document requirements?

Is there a sufficient financial reserve in the Building Code Services financial framework to temporarily reduce the permitting rates?

Can city staff review the report by the Canadian Federation of Independent Business with a goal of pursuing some of the best practices identified?
