Call to order and moment of reflection

The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, 15 May 2024 beginning at 10:00 a.m. The Mayor, Mark Sutcliffe, presided over the meeting from Council Chambers with some Members attending in person and the remaining Members participating remotely by Zoom.

The Mayor noted that prior to observing a moment of silence for Ms. Diane Deans, he asked that she be remembered for her 28 years of service to the community and the impact she had on many people.

He asked that Members keep Ms. Deans’ husband Ron, daughter Megan, grandson Evan and her family and friends in their thoughts as they grieve the loss of a dedicated woman and Council Member.

  1. that staff report back with options to exempt, or exclude, century homes that have been abandoned for decades or hunt camps that are recreational in the rural area from the VUT declaration process; and
  2. that staff develop and report back in the Fall VUT update with an exemption to exclude properties in the rural area that are not fit for occupation, such as properties with no access to services or properties that can only be used seasonally and cannot be occupied full time for the purpose of residential housing.

12.1

Motion - Proposed Irish Famine Grave Monument at Macdonald Gardens Park, Ottawa

• Committee recommendations as amended

  That Council approve :

  1. That Ottawa will participate in the Bronze Shoes project by facilitating the erection of an Irish Famine Grave Monument within Macdonald Gardens Park as a restoration of the memory of those victims of the Great Irish Famine whose remains lie in Ottawa, and as a space to contemplate humanity’s capacity for compassion and resilience; and
  2. That staff be directed to work with the Bytown Famine Monument Committee to resolve details such as installation details, required permits, and maintenance and liability requirements; and,
  3. That, while careful to preserve the heritage attributes and facility of Macdonald gardens Park for the citizens of Ottawa at the proposed site, the memorial will serve a number of purposes:
     • To thank Canada for its response to the Irish humanitarian disaster and to recognize the particularly heroic efforts of the Anishinaabe, Haudenosaunee and Wendat First Nations and other first responders who received the unprecedented waves of famine refugees suffering from an unknown disease of often-fatal effect, even at the cost of their own lives.
     • To remember the victims of the Great Irish Famine who arrived in Bytown and to recall the great humanitarian disaster that reached Canadian shores.
     • To celebrate the resilience of the human spirit in the face of disaster; that though twenty thousand Irish died, ninety thousand survived and prospered with the gift of hope and a new beginning in Canada.
     • To enrich the public experience of the existing city park by introducing a sobering reminder of the original purpose of the site as a resting place through innovative design.
     • To create a space for contemplation on ground hallowed by the city’s history and the remains who lie there.
     • To create an inspirational symbol of the power of compassion, hope and opportunity to transform the lives of all those who arrive on a stranger’s shore.

An Administrative Penalty System (APS) for Parking and Camera-Based Automated Enforcement Violations for the City of Ottawa

  1. The establishment of an Administrative Penalty System (APS) for the enforcement, processing, and resolution of parking by-law contraventions, red-light camera and automated speed enforcement contraventions detected by camera systems, in accordance with the Municipal Act, 2001, Regulation 333/07, and the Highway Traffic Act, 1990, Regulation 355/22, in place of the current system administered under the Provincial Offences Act (POA), as further described in this report;
  2. The APS By-Laws and APS Appointment By-Law, substantially in the form set out in Documents 1 and 2 and 3 of this report, and delegate the authority to the City Solicitor to finalize the required by-laws;
  3. The APS Conflict of Interest Policy and the APS Prevention of Political Interference Policy set out in Documents 4 and 5 of this report, as required by the Municipal Act, 2001, Regulation 333/07, and the Highway Traffic Act, 1990, Regulation 355/22.

  1. Declare 250 Forestglade Crescent, being 04165-0476, shown as Parcel 1 on Document 1 attached as surplus to City requirements;
  2. Waive section 1.2 of the City’s Disposal of Real Property Policy pertaining to the disposal of real property at current market value, Section 2.3 pertaining to the public marketing of viable properties, and Section 4.1 pertaining to the appraisal of the property; and
  3. Approve that the Director, Housing Solutions and Investments, together with the Director, Housing Services, be delegated authority to enter into, conclude, execute, amend, and implement on behalf of the City, the required agreements for the sale of 250 Forestglade Crescent and transfer the property, for nominal consideration, subject to existing easements and any easements that may be required, to the Ottawa Aboriginal Coalition for the purposes of developing the site for transitional housing.

2024 Provisional Development Charges Background Studies and By laws

  That Council: 

  1. Approve the provisional 2024 City-wide and Area-specific Development Charges Background Study dated March 15, 2024, and the provisional 2024 Stormwater Management Area-Specific Development Charges Background Study dated March 15, 2024, as amended by Motion PHC 2024-27-01
  2. Approve the provisional City-wide and area-specific Development Charge by-laws, to repeal and replace the Development Charge by-laws enacted in 2019, as detailed in Documents 1-12, as amended by Motion PHC 2024-27-01
  3. Determine that no further public meeting is necessary. 
  4. Approve:
     1. that the Development Charges By-law 2024 (Document 1) be amended, with applicability to the other development charges by-laws, to insert a requirement for the phase-in provisions within the Development Charges Act, subsection 5(6), paragraph 4.
     2. that the Development Charges By-law 2024 (Document 1) be amended, with applicability to the other development charges by law, such that should be phase-in provisions be repealed by the Parliament of Ontario, they shall be of no further effect in the development charges by-law seven calendar says after the effective date of their legislative repeal.

  WHEREAS the current area specific development charge for the Riverside South Stormwater Area is $8,013 for a single detached unit; and

  WHEREAS the area specific stormwater development charge for Riverside South in the 2024 Stormwater Management Area-Specific Development Charges Background Study has been calculated to be $4,929 for a single detached unit; and

  WHEREAS submissions have been made to the City by the front-ender of works being reimbursed by the area specific development charge that not all relevant growth-related costs have been included in the calculation of the revised development charge; and

  WHEREAS staff agree it would be appropriate to review the calculations of the Riverside South stormwater area specific development charge; and

  WHEREAS the goal of this review is to ensure that the correct amount is being imposed as the Riverside South stormwater area specific development charge; and

  WHEREAS pending such review, keeping the current area specific development charge in place is in the opinion of staff is appropriate;

  WHEREAS a development charge by-law is not subject to an appeal to increase a development charge; and

  WHEREAS if a reduction in the development charge is ultimately determined to have been appropriate, the funds to provide any necessary refund can be provided by withholding repayment of funds to the front-ender;

  THEREFORE BE IT RESOLVED That section 10 (Transitional Provisions) of the proposed area specific development charge for Riverside South be amended to read in accordance with the following:

  
   10. (1) Subject to subclause (2), the development charge rates calculated in accordance with By-law 2019-157 according to the development charge rates in effect on May 14, 2024 shall be in effect pursuant to this by-law from the date of the enactment of this by-law until August 30, 2024.
   (2) The provisions in subclauses 12(2) and 12(3) of the Development Charges By-law, 2024 do apply to the development charges imposed by this by-law.

  
  THEREFORE BE IT FURTHER RESOLVED, that pursuant to the Development Charges Act, subsection 12(3), no further public meeting is necessary.

  That staff be directed to provide the following in advance of or alongside the next Comprehensive Review of the DC By-law:

  • A comparison of Ottawa’s DC rates to Toronto, Hamilton, London, and Barrie in relation to DC service categories that we charge for and those which we do not;
  • DC service categories as a percentage of overall DC costs;
  • Service area boundaries and rates for DC service categories across those boundaries;
  • Benefit to existing component of growth projects and services; and
  • Historical (or planned) levels of service for different services.

  The companion report prepared by Hemson Consulting Ltd. dated March 15, 2024, entitled 2024 City-wide and Area-specific Development Charges Background Study, (Appendix C, Section 5.4  Area Specific Facilities) identifies a Community Centre in the central area of the City to be funded in part from Development Charges.  

  That staff be directed to consider the Vanier area when determining the location of this new Community Center.

Race Weekend Parking

  WHEREAS Ottawa Race Weekend is scheduled for May 24 to May 26, 2024, with the Health and Fitness Expo included as a two-day event being held at Aberdeen Pavilion in Lansdowne Park for the second year in a row; and

  WHEREAS the Expo is also the site of Race Kit Pick-Up on Friday, May 24 and Saturday, May 25; and

  WHEREAS Ottawa Race Weekend has requested the City of Ottawa waive the cost to park in the City Hall garage as part of encouraging participants to utilize transit to get to Lansdowne Park and obtain their race kits; and

  WHEREAS implementing free evening and weekend parking at City Hall during Ottawa Race Weekend would result in an estimated $3,000 in foregone parking revenues and thus a reduced contribution to the Parking Reserve Fund;

  THEREFORE BE IT RESOLVED that City Council approve that free parking at the City Hall parking garage located at 110 Laurier Avenue will be provided from Friday, May 24 at 6:00 pm until Sunday, May 26 at 9:00 pm.

AMO Board of Directors - Councillor Brockington

  WHEREAS the Association of Municipalities of Ontario (AMO) Annual Conference and Annual General Meeting will take place August 18-21, 2024, in Ottawa, during which elections for AMO’s Board of Directors will be held; and

  WHEREAS, since 2018, Councillor Riley Brockington has represented the City of Ottawa on the AMO Board of Directors, as a Director in the Regional and Single Tier Caucus; and

  WHEREAS, since 2022, Councillor Brockington, in addition to serving on the Board of Directors, was elected Chair of the Regional and Single Tier Caucus and serves on AMO’s Executive Council,

  WHEREAS, during Councillor Brockington’s tenure with AMO, he has sought the opinion from City staff on a number of subject matter issues, advocated strongly for the City of Ottawa on key priorities, hosted the first ever caucus-wide virtual session with AMO members and AMO staff, which included members of Ottawa City Council, champions the City of Ottawa to host major AMO conferences, such as the annual AGM and passionately supports AMO’s work on behalf of Ontario’s municipalities.

  WHEREAS AMO’s Call for Nominations for the 2024-2026 AMO Board of Directors opened in April 2024 and closes in June 2024 and Councillor Riley Brockington has expressed his interest to stand for re-election to the Board as a Director in the Regional and Single Tier Caucus; and

  WHEREAS a Council Resolution of support is required in order for Councillor Brockington to stand for this office; and

  WHEREAS AMO provides partial reimbursement of Directors’ travel expenses in accordance with their Board/Executive/Volunteer Expense Reimbursement Policy, and any costs of the Member’s participation over and above those reimbursed by AMO will be paid by the Council Administration Budget;

  THEREFORE BE IT RESOLVED THAT Ottawa City Council approves the nomination of Councillor Riley Brockington to stand for re-election for the position of Director, Regional and Single Tier Caucus, on the AMO Board of Directors for the 2024-2026 Term.

Hydro Wire Burying on Bank Street

  WHEREAS Bank Street is designated as a Traditional Mainstreet in the Official Plan (OP), and this designation is among the OP's intensification target areas and Design Priority Areas, and

  WHEREAS the City is undertaking a full integrated renewal of Bank Street (From Old Ottawa South, Billings Bridge, Riverside to Walkley Road), including underground infrastructure and utilities and this represents a once in 75 year opportunity to achieve economies of scale; and 

  WHEREAS Bank Street (Riverside to Ledbury) is a mixed-use area with significant development potential, businesses, transit stops, and is being re-designed to better facilitate pedestrian activity, traffic safety, and bicycling; and
   
  WHEREAS the required five-metre development setback from overhead hydro lines translates into a loss of development potential in some areas and therefore a loss of development-related revenue and foregone taxable property assessment potential;

  WHEREAS there are currently new developments that are being planned for 1330, 1335, 1400 Bank and other areas that could benefit from buried hydro wires, making this an opportune moment for burial;

  WHEREAS there is more intensification that has been revealed through the comprehensive zoning bylaw update planned along Bank Street and significant business frontages on this corridor;

  WHEREAS this proposed hydro burial would comply with direction in the New Official Plan;

  WHEREAS the additional cost for hydro burial will be an additional future capital project ask, subject to Council approval;

  WHEREAS opportunities for resilience in the grid don’t come along often and Ottawa has been seeing more wind storms, power outages, and repairs required;

  THEREFORE BE IT RESOLVED THAT Council requests staff to investigate and include Hydro wire burial along select sections of Bank Street in the renewal area subject to project scope, estimates and funding to be confirmed.

  WHEREAS The City’s commemorative naming policy seeks to recognize individuals that have demonstrated excellence, courage or exceptional service to the citizens of the City of Ottawa; and 

  WHEREAS Diane Deans was one of the longest serving Councillors in the City of Ottawa’s history, proudly representing the residents of Gloucester-Southgate Ward for more than 28 years; and 

  WHEREAS Diane dedicated her life to public service and worked tirelessly for her community, championing a number of initiatives to improve the quality of life in Gloucester-Southgate Ward and the City; and 

  WHEREAS Diane was instrumental in advancing the expansion of the Greenboro Community Centre and creation of the Greenboro Library, both of which have become a central gathering hub and community space; and  

  WHEREAS the Community Centre is just one of the many contributions that Diane has made, and recognizing this contribution will serve to not only honour her memory, but also to remind us all of an amazing woman who truly made a difference; and 

  WHEREAS it is appropriate to proceed today with this motion while the Commemorative Naming Policy continues to be under review; 

  THEREFORE BE IT RESOLVED that the facility formally known as ‘Greenboro Community Centre’, located at 363 Lorry Greenberg Drive, ON K1T 3P8, be renamed the “Diane Deans Greenboro Community Centre”; and 

  BE IT FURTHER RESOLVED that an appropriate stand and plaque be installed displaying the name and including a brief history of Diane Deans’ contributions; and 
  BE IT FURTHER RESOLVED that all costs related to the production and installation of the stand, plaque and subsequent event will be funded through the Councillor’s office.

  WHEREAS Council approved the Brownfields Grant Application for 36-46 Robinson Avenue on April 14, 2021 (File Number ACS2021-PIE-PS-0022) and the subsequent Brownfields Grant Agreement was registered as document OC2557811 on November 28, 2022; and

  WHEREAS the Council approval and agreement is to the name of Robinson Village IV Limited Partnership, by its General Partner, Robinson Village GP IV Inc.; and

  WHEREAS since that time, Robinson Village IV Limited Partnership, by its General Partner, Robinson Village GP IV Inc. has been bought out by a number of the partners and a new corporation, Capital Park II LP, by its General Partner, Capital Park Holdings II Inc., was created which now owns the property; and

  WHEREAS the rehabilitation of the site and construction has been completed and the request for reimbursement has been received by the City of Ottawa; and

  WHEREAS the amount of reimbursement will not change.
   
  THEREFORE BE IT RESOLVED the Brownfield grant payments for 36-46 Robinson Avenue be directed to Capital Park II LP, by its General Partner, Capital Park Holdings II Inc.

  WHEREAS the participation rates of Canadians engaging in healthy physical activities has declined, while inactivity and obesity continues to rise in Canada; and

  WHEREAS health and fitness ought to be promoted and embraced by Canadians of all ages and abilities; and

  WHEREAS many Canadian cities have taken up the annual challenge of encouraging and promoting physical activity, including Calgary, Saskatoon, Montréal and Victoria; and

  WHEREAS the City of Ottawa offers a multitude of recreation and leisure programming and promotes active and healthy living through a number of initiatives; and

  WHEREAS the City of Ottawa has previously offered incentives to residents to embrace physical activity and fitness in recognition of past National Health and Fitness Days; and

  WHEREAS Ottawa Public Health has indicated that staying active is a positive coping strategy to taking care of your mental health; and 

  WHEREAS the City of Ottawa Departments (Ottawa Public Health, Recreation, Cultural and Facility Services Department and others) work together on improving access to and encouraging physical activity for residents; and

  WHEREAS the City of Ottawa encourages residents to get outside and enjoy outdoor amenities such as parks, hiking and bike trails, courts, and skateboard parks; and

  WHEREAS The City of Ottawa has a “Play Free” initiative offering a selection of free drop-in programming for children and youth; and

  WHEREAS the City of Ottawa wishes to encourage all residents to embrace physical activity and fitness by participating in Free Play activities, as well as a free virtual Zumba class on Saturday, June 1, 2024 in recognition of 2024 National Health and Fitness Day; 

  THEREFORE BE IT RESOLVED that City Council declare Saturday, June 1, 2024 to be National Health & Fitness day in Ottawa.

Commemoration – 100th Anniversary Royal Canadian Air Force (RCAF)

  WHEREAS 2024 is the 100th anniversary of the Royal Canadian Air Force (RCAF);

  WHEREAS the RCAF has helped preserve the freedoms of all Canadians, contributed to global peace and security, and to helped those in need in Canada and abroad; and

  WHEREAS the RCAF provides air defence, maritime patrol, search and rescue, air mobility and sustainment, aerospace control, and space capabilities to support operations at home and abroad; and

  WHEREAS the RCAF is a respected military partner worldwide, providing security at home through NORAD and working with our NATO allies and partners to maintain peace and stability across the globe; and

  WHEREAS the City of Ottawa has been the location of important RCAF operations including CFB Rockcliffe, CFB Uplands, CFS Leitrim and other RCAF activities; and

  WHEREAS RCAF aircraft and the RCAF aeronautical team Snowbirds have been a central and iconic feature of Ottawa’s Canada Day celebrations; and

  WHEREAS the RCAF, as a national institution, has played a role in shaping Ottawa as a City, and forged its own place in the local story; and

  WHEREAS it is fitting for the National Capital to commemorate the 100th Anniversary of the RCAF; and

  WHEREAS the City Archivist has access to a collection of local RCAF artifacts and photographs, an annual budget for important public displays, and supports commemorating the 100th Anniversary of the RCAF; and

  WHEREAS the Ottawa Public Library has a collection of RCAF historical reading material;

  THEREFORE BE IT RESOLVED the City Archivist develop and make available a temporary public display at Ottawa City Hall to commemorate the 100th anniversary as part of their 2024 annual programming; and

  BE IT FURTHER RESOLVED that a tree be planted in Claudette Cain Park in Riverside South as part of the planned 2024 tree planting program to commemorate the RCAF’s 100th anniversary and that an appropriate plaque be installed to commemorate this event with all costs related to the production and installation of the plaque be funded through the Ward 22 constituency services budget; and

  BE IT FURTHER RESOLVED that City Council request that the Ottawa Public Library Board consider publishing and promoting a curated list of RCAF readings or other media in both official languages from the library collection.

City permit fees for demountable stages applicable to not-for-profit fundraisers

  WHEREAS the Ontario Building Code was amended on February 28, 2023, requiring building permit applications for demountable stages and associated sound and lighting equipment towers, as further prescribed by Regulation 30/23; and

  WHEREAS local not-for-profit community fundraisers and not-for-profit Canada Day community events are now required to obtain a permit for their demountable stages; and

  WHEREAS the costs associated with this new requirement has an impact on not-for-profit and community organizations, and local organizations have requested an exemption from the building permit fees established by the City’s Building By-law 2014-220, as amended, which are currently $11.30 per square foot value of the construction with a minimum cost of $103;
   
  THEREFORE BE IT RESOLVED that City Council delegate the authority to the Chief Building Official to waive building permit application fees established by the City’s Building By-law 2014-220, as amended, for not-for-profit permit applicants who apply for a demountable stage permit as required by the Building Code Regulation 30/23 for their fundraising event.

Bytown Fire Brigade

  WHEREAS the Bytown Fire Brigade is a non-profit Ottawa-based organization established in 1983 to serve the community as a local historical society with a mission to collect, preserve, conserve, restore and display the artifacts and apparatus that tell the history of firefighting in Canada's capital and the country as a whole; and 

  WHEREAS the Bytown Fire Brigade has expressed an interest in strengthening its relationship with the City of Ottawa for the purposes of building capacity and expanding its community reach; and

  WHEREAS the City of Ottawa operates several cultural programs, including City-owned museums and historic sites, along with various forms of cultural funding through museum service agreements, heritage service agreements, and the heritage funding program, including project funding, annual operating funding, multi-year operating funding; and 

  WHEREAS the City Archives maintains its own partnership agreements and other relationships, including those with the Friends of the City of Ottawa Archives, historical societies, religious organizations, and individual volunteers; 

  WHEREAS the City Archives, as part of its mandate, acquires and makes available city and community records, including those of first responders, such as Ottawa Fire Services; 

  THEREFORE BE IT RESOLVED that the City Clerk and General Manager, Recreation, Cultural, and Facility Services be directed to engage with the Bytown Fire Brigade to explore various options for strengthening the City’s relationship with the Bytown Fire Brigade and to identify ways that the City may assist them building capacity and reach for their community work.
