This is a public meeting to consider the proposed Comprehensive Official Plan and Zoning By-law Amendments listed as Item(s) 4.2, 4.4 - 4.8, 4.10 and 4.12 – 4.15 on today’s Agenda.

For the item just mentioned, only those who make oral submissions today or written submissions before the amendments are adopted may appeal the matter to the Ontario Land Tribunal. In addition, the applicant may appeal the matter to the Ontario Land Tribunal if Council does not adopt an amendment within 90 days of receipt of the application for a Zoning By-law Amendment and 120 days for an Official Plan Amendment.

    WHEREAS A Community Benefits Agreement (CBA) is an agreement, typically involving developers of infrastructure and building projects, municipal or other governments, and community coalitions, intended to achieve a broad range of socio-economic outcomes from infrastructure and building projects. 
    Whereas Community Benefits Agreements (CBAs) are typically founded on a shared, legally binding commitment between government, the private sector (e.g., developers and contractors) and communities to commit to socio-economic outcomes from construction and infrastructure projects through an effective, efficient, transparent, fair and inclusive process. 
    Whereas there are approximately 400 CBAs implemented or under negotiation in North America. 

    WHEREAS comparable programs to Build Ottawa, like Housing Now in the City of Toronto, have included the development of community benefits agreements as a condition of disposal of property. 

    WHEREAS potential community benefits may include, but not be limited to equitable hiring practices, funding for training, public realm enhancements; and greater accessibility; and 

    WHEREAS Build Ottawa is mandated to seek “Optimal Value” to the City’s taxpayers, which is to be seen as pertaining to both community and economic benefits; and 

    WHEREAS Community Benefits Agreements have also been negotiated as part of major development applications in Ottawa, such as the Manor Park Estates and Herongate agreements; and, 

    WHEREAS recent provincial legislation including Bill 23 and Bill 109 has significantly reduced the amount that developers are required to contribute in terms of community benefit, through the elimination of Section 37 and the introduction of Community Benefits Charges; 

    THEREFORE BE IT RESOLVED that Build Ottawa be directed to incorporate potential community benefits including, but not be limited to equitable hiring practices, funding for training, public realm enhancements; and greater accessibility when developing evaluation criteria for the disposal of surplus lands.

    1. That Planning and Housing Committee recommend Council approve an amendment to Zoning By-law 2008-250 for 300 Goulbourn Forced Road, as shown in Document 1, to amend performance standards for two-storey dwellings, as detailed in Document 2.

    That the Built Heritage Committee and the Planning and Housing Committee recommend that Council:

    1. Approve the application to demolish 110 York Street;
    2. Approve the application for new construction at 110 York Street according to plans prepared by Neuf Architects, dated September 18, 2023, conditional upon:
      1. The applicant providing samples of all final exterior materials for approval by Heritage Planning staff prior to the issuance of the building permit.
      2. The installation of a mural or an artistic installation on the east wall of the building as a condition of Site Plan approval.
      3. Minor alterations on the podium to better reflect the richly detailed architectural character of the ByWard Market Heritage Conservation District including:
        1. Ensuring that glazing in windows and doors is transparent to provide a more active frontage on York Street, reflecting the importance of the street as a gateway to the core of the ByWard Market HCD;
        2. Refining the architectural details of the east wall of the podium through the addition of decorative brick work or similar architectural detailing to the satisfaction of Heritage Planning staff, prior to the issuance of the building permit
    3. Delegate the authority for minor design changes to the General Manager, Planning, Real Estate and Economic Development Department;
    4. Approve the issuance of the heritage permits for each application with a two-year expiry date from the date of issuance.

    1. Approve the application to demolish 283 and 285 McLeod Street, conditional upon;
      1. The applicant depositing photographs and research material related to the site’s existing buildings to the City of Ottawa Archives, as required by Policy 5.6 of the Centretown and Minto Park HCD Plan;
      2. The installation of a plaque commemorating the work of local builder David Younghusband in consultation with Heritage Planning staff as a condition of Site Plan approval.
    2. Approve the application for new construction at 283-285 McLeod Street according to plans prepared by Colizza Bruni Architecture, dated April 25, 2023, conditional upon:
      1. Refining the architectural treatment of the east façade to the satisfaction of Heritage Planning staff, prior to the issuance of the building permit

      1. An amendment to the Official Plan, Volume 2A, Central and East Downtown Core Secondary Plan, to permit a mid-rise building at a maximum height of five storeys for the property municipally known as 283 and 285 McLeod Street, as detailed in Document 2; and,
      2. An amendment to Zoning By-law 2008-250 for 283 and 285 McLeod Street to rezone the lands shown on Document 1 from R4U [478] and R4UD [479] to R5B [xxxx] H(19) to permit a five-storey mid-rise apartment, including a site-specific exception, as detailed in Document 3.
    2.     That the Built Heritage Committee and Planning and Housing Committee recommend that Council:

    1. Approve the application to alter 359 Kent Street and 436 and 444 MacLaren Street according to plans prepared by Hobin Architecture Incorporated, dated July 28, 2023, conditional upon:
      1. The approval of the associated Official Plan Amendment and Zoning By-law Amendment applications (ACS2023-PRE-PS-0123) and the approval of the associated Site Plan Control application.
      2. The applicant providing financial securities through a Letter of Credit to ensure the protection, conservation, and restoration of the building at 359 Kent Street prior to the issuance of a building or demolition permit related to the deconstruction. 
      3. Submission of final elevations of the tower portion of the proposal for approval under delegated authority by the General Manager, Planning, Real Estate and Economic Development Department. 
      4. The implementation of the conservation measures identified in the Conservation Plan attached as Document 10, which will be monitored through ongoing reports submitted by the applicant in consultation with their heritage consultant to the satisfaction of Heritage Planning Staff, commencing prior to the issuance of a building or demolition permit related to the deconstruction of the building at 359 Kent Street.
      5. The applicant providing samples of all final exterior materials, for approval by Heritage Planning staff prior to the issuance of the building permit.
      6. The applicant providing a Documentation and Salvage Plan to the satisfaction of staff in Heritage Planning that describes the documentation process for the building and identifies opportunities for the retention of existing building material where possible.
    2. Delegate the authority for minor design changes to the General Manager, Planning, Real Estate and Economic Development Department;
    3. Approve the issuance of a heritage permit with a four year expiry date from the date of issuance unless otherwise extended by Council.

    WHEREAS the Application to alter 359 Kent Street, 436 and 444 MacLaren Street, properties designated under Part V of the Ontario Heritage Act as part of the Centretown Heritage Conservation District report (ACS2023-PRE-RHU-0047) and the Official Plan Amendment and Zoning By-law Amendment – 359 Kent Street, 436 and 444 MacLaren Street report (ACS2023-PRE-PS-0123) now list incorrect Committee and Council dates on their respective cover pages and must be updated to reflect accurate dates.

    THEREFORE BE IT RESOLVED the City Council date for reports ACS2023-PRE-PS-0123 and ACS2023-PRE-RHU-0047 be changed to January 24, 2024 / 24 janvier 2024 on the report cover page; and

    BE IT FURTHER RESOLVED regarding report ACS2023-PRE-RHU-0047, that the Office of the City Clerk be directed to update the Built Heritage Committee date on the cover page to add the January Built Heritage Committee date once it is finalized.

    2. That Planning and Housing Committee recommend to Council that Council’s endorsement of the Official Plan Amendment and Zoning Amendment be conditional upon the applicant executing an agreement, to the satisfaction of the City Solicitor that provides for 15 affordable housing units in each tower for 15 years as described in this report.

    WHEREAS the report (ACS2023-PRE-PS-00136) titled “Ontario Land Tribunal Settlement – 1047 Richmond Road/ Règlement du Tribunal ontarien de d'aménagement du territoire – 1047, chemin Richmond” was not originally listed on the agenda, and was subsequently published with the revised agenda on Friday, November 10, 2023;

    THEREFORE BE IT RESOLVED that the Planning and Housing Committee approved this item be formally added to the agenda pursuant to Subsection 89(3) of the Procedure By-law (being By-law NO 2022-410), to allow for the consideration at this meeting.

    WHEREAS residents see value in affordable housing and traffic calming; and,

    WHEREAS these are two issues that are commonly subjects of discussion during development application consultations; and,

    WHEREAS discussions between Katasa Group and Councillor Menard’s office have concluded in the former voluntarily agreeing to contribute funds toward traffic calming and affordable housing in Ward 17; and,

    THEREFORE BE IT RESOLVED that Planning and Housing recommend that City Council authorize the City of Ottawa to enter into a Memorandum of Understanding (MOU) with Katasa Group for the purposes of realizing the following two voluntary contributions:

    1. $100,000 for the Ward 17 traffic calming budget; and,
    2. $200,000 for affordable housing in Ward 17. The use of these funds is under the discretion of the General Manager of Community and Social Services (in consultation with the Ward Councillor)

    That the rules of procedure be waived to consider the matter below at the November 15, 2023 meeting of  Planning and Housing Committee. 

    WHEREAS report ACS2023-PRE-PS-0081 was approved by Council on 12 July 2023, with a recommendation for the City to enter into a Front-Ending Agreement with Mattamy (Monarch) Limited for the design and construction of the roundabout at Longfields Drive and Kilspindie Ridge to an upset limit of $4,484,376.46 plus applicable taxes and indexing; and
    WHEREAS the financial implication of the report erroneously stated that “the capital accounts will be established with budget authorities of the upset limits, 100 per cent funded by development charges”; and

    WHEREAS the intended financial implication was meant to instead state: “the capital accounts will be established with budget authorities of the upset limits, 95 per cent funded by development charges, and 5 per cent by tax.”;

    THEREFORE, BE IT RESOLVED THAT report ACS2023-PRE-PS-0081 be revised so that any mention of “100 per cent development charges funded” be replaced with “95 per cent funded by development charges, and 5 per cent by tax”.
