Except where otherwise indicated, reports requiring Council consideration will be presented to Council on Wednesday, October 11, 2023 in Agriculture and Rural Affairs Committee Report 7.

This is a public meeting to consider the proposed Comprehensive Official Plan and Zoning By-law Amendments listed as Item 4.1-4.4 on today’s Agenda.

For the item just mentioned, only those who make oral submissions today or written submissions before the amendments are adopted may appeal the matter to the Ontario Land Tribunal. In addition, the applicant may appeal the matter to the Ontario Land Tribunal if Council does not adopt an amendment within 90 days of receipt of the application for a Zoning By-law Amendment and 120 days for an Official Plan Amendment.

ACS2023-PRE-PS-0107 - Osgoode (20)

The Applicant/Owner as represented by Barrett Wagar, Stantec and Michael Campbell, Hydro Ottawa Limited were present in support, and available to answer questions. The Applicant advised that they did not need to address the Committee if the item carried.

The Committee heard from the following delegations:

  • Christine Vestervelt expressed expressed concerns related to, however not limited to the notification process, lack of communication and feedback from Hydro Ottawa, affects on physical and mental health and noise and environmental concerns.

That the Agriculture and Rural Affairs Committee approve the Consultation Details Section of this report be included as part of the ‘brief explanation’ in the Summary of Written and Oral Public Submissions, to be prepared by the Office of the City Clerk and submitted to Council in the report titled, “Summary of Oral and Written Public Submissions for Items Subject to the Planning Act ‘Explanation Requirements’ at the City Council Meeting of October 11, 2023,” subject to submissions received between the publication of this report and the time of Council’s decision.

Sean Harrigan, Planner I, Planning, Real Estate and Economic Development Department (PRED), provided an overview of the report and answered questions from the Committee.  A copy of the slide presentation is filed with the Office of the City Clerk. 

The Applicant/Owner as represented by Jacob Bolduc, Fotenn provided an overview of the Application and responded to questions from Committee.  A copy of the slide presentation is filed with the Office of the City Clerk.

The Committee heard from the following delegations:

  • Jennifer Murphy expressed concerns related to increased traffic and the impacts the proposed development will have on the safety of pedestrians and cyclists.

    1. That Agriculture and Rural Affairs Committee recommend Council approve amendment to Zoning By-law 2008-250 for 5646 and 5650 Manotick Main Street, as shown in Document 1, to permit a restaurant with a drive through, as detailed in Document 2.
    2. The Applicant/Owner as represented by Chris Clarke, ZanderPlan Inc provided an overview of the Application and responded to questions from Committee.  A copy of the slide presentation is filed with the Office of the City Clerk.

The Committee heard from the following delegations:

  1. Tim Parsons spoke to a slide deck, a copy of which is on file with the Office of the City Clerk.  The presentation touched on concerns related to environmental impacts, increased truck traffic and suggested additional restriction should be added to the amendment. 
  2. Marc Sauve, Metcalfe Community Association also expressed concerns with increased truck traffic and how the traffic flow could be alternately routed.
  3. Anne Parsons expressed concerns with the proposal and the increase in truck traffic.
  4. Lynda Muckle noted approving this application to rezone to allow for industrial use will set a precedent in the rural community, also expressing concerns with the increase in truck traffic as a result.

That Agriculture and Rural Affairs Committee recommend Council approve an amendment to the Official Plan for 2545 9th Line Road, as shown in Document 1, to permit a soil packaging plant with leaf and yard waste composting as an ancillary use while remaining within the Rural Countryside designation, as detailed in Document 2.
    2. That Agriculture and Rural Affairs Committee recommend Council approve an amendment to Zoning By-law 2008-250 for 2545 9th Line Road, as shown in Document 1, to Rural General Industrial with an exception to limit the uses to a soil packaging plant with leaf and yard waste composting as a conditional ancillary use, as detailed in Document 3.
    3. That Agriculture and Rural Affairs Committee approve the Consultation Details Section of this report be included as part of the ‘brief explanation’ in the Summary of Written and Oral Public Submissions, to be prepared by the Office of the City Clerk and submitted to Council in the report titled, “Summary of Oral and Written Public Submissions for Items Subject to the Planning Act ‘Explanation Requirements’ at the City Council Meeting of October 11, 2023,” subject to submissions received between the publication of this report and the time of Council’s decision.

ACS2023-PRE-EDP-0045 - City Wide 

  • Report recommendation(s)

    That the Agriculture and Rural Affairs Committee recommend Council authorize and direct the General Manager, Planning, Real Estate and Economic Development, to enter into written agreements with the Mississippi Valley Conservation Authority, the Rideau Valley Conservation Authority, and South Nation Conservation by January 1, 2024, as required by provincial legislation, so that they can continue to use municipal levy funds to deliver programs and services to Ottawa residents.

Lorne Franklin, and Andy Robinson, Robinson Consultants Inc., provided a detailed overview of the Engineer’s report and answered questions from the Committee.  A copy of the slide presentation is filed with the Office of the City Clerk. 

Mark Foster noted his family has invested money into landscaping, or GPS shaping on their property adjacent to the drain and indicated that putting soil back on the edge of the drain would eliminate work that has been invested and benefit lost.  As well, questioned how the cost for crops lost in construction was calculated and wondered if there was an opportunity to work with the cropping schedule proposed.

Sheryl Davidson noted she doesn’t understand why she has to pay for this drain as she does not own a farm and is unclear as to whether this construction will benefit her or not.

 

STATEMENT TO BE READ BY ARAC CHAIR TO PUBLIC
AT BEGINNING OF A “MEETING TO CONSIDER” AN ENGINEER’S REPORT
(October 2023)

“This meeting is only for the purpose of considering the Amendment to the Engineer’s report Amendments to the Simpson Municipal Drain Construction of the Biltmore Branch and Modification of Branch 3 and the By-law, and to receive any written or oral submissions with respect to the technical aspect of the Engineer’s Report”.

Consideration of appeals to assessments by landowners will be heard by the Court of Revision at another time, yet to be determined.  All assessed landowners will be provided with written notice of the time and place of the convening of the Court of Revision, and, will be provided with an opportunity to file an appeal their assessment by submitting it in writing to the Clerk.

The procedure will be as follows:  

  • Andy Robinson, P. Eng of Robinson Consultants Inc will provide a presentation.
  • Each landowner will have 5 minutes to explain their concerns with respect to their property and the technical aspects of the Engineer’s Report.
  • After each landowner presentation the members of ARAC may ask questions to the landowner or Mr. Robinson.

After all the landowner presentations have been heard ARAC will consider the staff report recommendation.

    That the Agriculture and Rural Affairs Committee recommend that Council adopt the engineer’s report prepared by Robinson Consultants Inc., entitled Engineer’s report amendments to the Simpson Municipal Drain construction of the Biltmore Branch and modification of Branch 3, and give first and second readings to the By-law attached as Document 3 in accordance with Sections 42 and 45 of the Drainage Act of Ontario.
