The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on Wednesday, March 22, 2023 beginning at 10:00 a.m. The Mayor, Mark Sutcliffe, presided over the meeting from Council Chambers with some Members attending in person and the remaining Members participating remotely by Zoom.

Mayor Sutcliffe led Council in a moment of reflection.

Retirement Recognition for Donna Gray, General Manager, Community Services Department

Mayor Sutcliffe, and Wendy Stephanson, Interim City Manager, offered recognition to Donna Gray, General Manager, Community Services Department, on the occasion of her impending retirement.

All Members of Council were present except Councillor C. Kitts.

    WHEREAS the City Council meeting of March 22, 2023, Council will consider recommended public member appointments to the Accessibility Advisory Committee for the 2022-2026 Term of Council; and

    WHEREAS the Committee also includes one Member of Council in a non-voting liaison capacity; and

    WHEREAS the Office of the City Clerk undertook a circulation to seek expressions of interest from Members of Council interested in participating in the Sponsors Group and received an expression of interest from Councillor Carr;

    That Council: 

    1. Approve the Brownfield Redevelopment Grant application submitted by Riverain Developments Inc. and 2799338 Ontario Inc. (common name Main and Main), owner of the property at 2 Montreal Road and 3 Selkirk Street, for Rehabilitation Grant under the Brownfield Redevelopment Community Improvement Plan (2015), not to exceed a total of $3,648,235 for which the grant payment period will be phased over a maximum of ten years of development, subject to the establishment of, and in accordance with, the terms and conditions of the Brownfield Redevelopment Grant Agreement; the maximum deferral of Development Charges of $3,101,000 under the Development Charge Deferral Program; and the estimated contribution of $817,141 towards the Municipal Leadership Strategy fund; 
    2. Delegate the authority to the General Manager, Planning, Real Estate and Economic Development, to execute a Brownfield Redevelopment Grant Agreement with Riverain Developments Inc. and 2799338 Ontario Inc., establishing the terms and conditions governing the payment of the grant for the redevelopment of 2 Montreal Road and 3 Selkirk Street, to the satisfaction of the General Manager, Planning, Real Estate and Economic Development Department, the City Solicitor and the Chief Financial Officer.

    WHEREAS at its meeting of February 27, 2023, Planning and Housing Committee approved the process to establish a Council Sponsors Group to provide input and advice to the 2024 Development Charge By-law and Community Benefits Charge By-law update, as detailed in report ACS2023-PRE-GEN-0001, as amended; and
    WHEREAS the Council Sponsors Group be made up of five Members of Council: two representatives of the suburban area, two representatives of the urban area (and directed that one be inner-urban and one outer-urban), and one member of the rural area as well as the General Manager Planning, Real Estate and Economic Development, or a designate, as well as other City staff as needed.; and
    WHEREAS the Planning, Real Estate and Economic Development Department undertook a circulation to seek expressions of interest from Members of Council interested in participating in the Sponsors Group and received expressions of interest from seven Councillors;

    WHEREAS the Ottawa Branch of the Polish Combatants' Association (Branch No. 8) has celebrated 75th anniversary; and 

    WHEREAS the original members of Branch No. 8 were former soldiers of the Polish Armed Forces, who fought alongside the Western Allies, including Canadians, during World War II; and

    WHEREAS in the last 75 years, Branch No. 8 and its members have made immeasurable contributions to the community and our city; and

    WHEREAS Branch No. 8 has worked with City staff to find a location for a tree to be planted at Centrepointe Park to commemorate this milestone anniversary in the spring of 2023; and

    WHEREAS the financial cost of the Commemorative Tree and the accompanying plaque will be borne by the Polish Combatants' Association Branch No. 8; and

    WHEREAS Public Works, Parks Maintenance and Forestry Services, will install the city standard flat black polished granite marker flush to the ground; 

    THEREFORE BE IT RESOLVED that City Council approve the installation of a plaque in Centrepointe Park to mark the 75th Anniversary of the founding of the Polish Combatants’ Association Branch No. 8; and 

    THEREFORE BE IT FURTHER RESOLVED that the plaque read “THIS TREE WAS PLANTED TO COMMEMORATE THE 75TH ANNIVERSARY OF THE FOUNDING OF THE POLISH COMBATANTS’ ASSOCIATION BRANCH NO. 8” in Polish, English, and French.

    WHEREAS On February 6, 2023, an incredibly destructive earthquakes 7.8 magnitude earthquake, followed by a series of strong tremors and aftershocks, devastated South-Eastern Türkiye; and

    WHEREAS the earthquake has already killed more than 41,000 people and injured more than 87,000; and

    WHEREAS more than a million people have been displaced, with at least 47,000 buildings destroyed or damaged; and 

    WHEREAS the Canadian and Turkish Women’s Association in Ottawa (CATWAO) are organizing a fundraising event to benefit the victims of the earthquake on April 23rd, recognized as Children’s Day in Turkey, to sell donated used goods, Turkish foods and to host children’s activities; and

    WHEREAS CATWAO is seeking the use of Jean Pigott Hall at City Hall to host this fundraising event in support of residents of Türkiye;  

    THEREFORE BE IT RESOLVED that Council approve the use of Jean Pigott Hall for this fundraising event on April 23rd and waive the rental fee and associated costs for furniture, equipment and staffing, to support the people of Türkiye following this devastating event.

    That the Rules of Procedure be suspended to consider the following motion in order to take advantage of early-bird pricing for conference registration prior to April 2;

    WHEREAS the City of Ottawa is a member of the Canadian Urban Transit Association (CUTA); and

    WHEREAS Councillor Wilson Lo has been formally invited by the Canadian Urban Transit Association to join their Transit Board Members Committee (TBMC); and

    WHEREAS the TBMC’s membership is comprised of municipal elected officials from across Canada and provides a venue for discussion and the promotion of public transportation among municipal decision-makers, and serves as a forum to share knowledge, insights, and experience, and help identify new and prevailing issues of interest to the sector and aid in addressing them; and

    WHEREAS meetings of the TBMC are held at the call of the chair 2-3 times a year, with the next meeting to be held in conjunction with the CUTA Spring Summit and Annual General Meeting taking place May 7-9, 2023, in Saskatoon, Saskatchewan; and

    WHEREAS if a Member is participating on a board in their capacity related to their role as a Member of Council, that participation should be approved by Council; and

    WHEREAS, subject to Council Approval, the Council Administration Budget will fund the travel costs associated with the participation of Council’s representatives to external municipal organizations; and

    WHEREAS all City-funded travel shall be subject to the requirements of the Council Expense Policy;
    THEREFORE BE IT RESOLVED that Council approve the participation of Councillor Wilson Lo on the Canadian Urban Transit Association’s Transit Board Members Committee; and

    BE IT FURTHER RESOLVED that Council approve the attendance of Councillor Lo in the CUTA Spring Summit and Annual General Meeting being held May 7-9 in Saskatoon, Saskatchewan; and

    BE IT FURTHER RESOLVED that the costs for Councillor Lo’s participation in the conference and future meetings of the Transit Board Members Committee be funded from the Council Administration Budget.

    BE IT RESOLVED that Rules of Procedure be suspended to permit the introduction of the following motion given the hearing with respect to 1 and 19 Sir John A Macdonald Parkway is approaching and a proposed settlement has been negotiated:

    BE IT RESOLVED that Council approve the resolution of the appeals by the National Capital Commission in respect of the refusal of Council to adopt an Official Plan Amendment and Zoning By-law Amendment in respect of 1 and 19 Sir John A Macdonald Parkway on the basis of recommendations by City Planning Staff as modified, where applicable, by the following principles:

    1. Diplomatic missions are a permitted land use; and
    2. No more than five lots shall be created; and
    3. No more than five principal buildings are to be constructed; and
    4. Parking is encouraged to be underground, parking at grade is to be sensitively screened, and if parking is above grade than it is to be integrated into the principal building and shall not be visible; and
    5. The lands to be redesignated as Neighbourhood and rezoned as Minor Institutional shall be revised to be only the lands to the west of a northerly projection of the eastern edge of Stonehurst Avenue; and
    6. A sidewalk shall be constructed on the north side of Burnside Avenue from Hinchey Avenue to Slidell Street and an active transportation connection on the northwest side of Slidell Street from Burnside Street to Sir John A Macdonald Parkway at the time of the construction of the first embassy; and
    7. A pedestrian corridor will be provided to the north of the Riverton Apartments between Forward Avenue and Hinchey Avenue; and
    8. A holding zone shall be imposed that shall only be lifted in accordance with the requirements with respect to transportation impact assessment criteria in Document 3 in the staff report as revised by Council on February 9, 2022.

    BE IT FURTHER RESOLVED that the City Solicitor be authorized to execute Minutes of Settlement in accordance with the above principles subject to such modifications as may be agreed to by the Mayor and the Ward Councillor.

    WHEREAS the Ottawa Sports and Entertainment Group (OSEG) would like to use firework related smoke devices at Ottawa Athletico Games at TD Place and;

    WHEREAS OSEG has developed procedures to ensure the safety of staff and patrons of the events and;

    WHEREAS the City of Ottawa prohibits the use of smoke devices in By-law No. 2003-237, as amended, being the Fireworks By-law and;

    WHEREAS OSEG has used smoke devices in 2017 – 2022 seasons with prior approval by City Council and received no complaints and;

    WHEREAS Ottawa Fire Services (OFS) has been consulted on the smoke devices and believes these devices can be used safely;

    THEREFORE BE IT RESOLVED that the City of Ottawa grant an exemption to By-law No. 2003-237, as amended, to the Ottawa Sports and Entertainment Group (“OSEG”), to allow for the use of smoke devices for Athletico Games starting April 15, 2023 until December 31, 2026, for home games and playoff games, if required, and granting OSEG an exemption from Section 17 of the By-law, which requires a permit application to be made 30-days in advance to the proposed use, subject to OSEG meeting all other permit requirements of the By-law, including Section 18, to the satisfaction of the Fire Chief; and

    BE IT FURTHER RESOLVED that following the 2024 season, the General Manager of Emergency and Protective Services issue a memo to Council summarizing any issues raised by the public, OSEG or OFS regarding the use of smoke devices at TD Place.

    WHEREAS on January 31, 1923, the Government of Canada authorized the organization of a force to be called the Royal Canadian Navy Volunteer Reserve (“RCNVR”); and

    WHEREAS the RCNVR served as the backbone of the Royal Canadian Navy recruiting sailors from across the country including the Ottawa area; and

    WHEREAS Ottawa’s local naval reserve unit, HMCS Carleton, was also formed in 1923; and

    WHEREAS the RCNVR played a critical role during the Second World War helping establish the third largest navy in the world, with 95,000 men and women in uniform, and 434 commissioned vessels including cruisers, destroyers, frigates, corvettes and auxiliary vessels; and

    WHEREAS Naval reservists are members of the Royal Canadian Navy who typically serve on a part-time basis. Reservists are employees, co-workers and students from the community who embody the courage, loyalty and integrity; and

    WHEREAS Naval reservists have deployed on operations at sea and on land around the world, from counter-narcotics missions in the Caribbean and Pacific Ocean to sovereignty patrols in Canada’s Arctic; and

    WHEREAS Naval reservists have supported provincial and local authorities in domestic operations including support to flooding and care for seniors in Ontario and Quebec during the early days of the Covid-19 pandemic; and

    WHEREAS local commemorative events will include restoration and rededication of the Royal Canadian Navy Reserve Anniversary Monument and the annual Navy Bike Ride; and

    WHEREAS the City of Ottawa in its role as the Nation’s Capital should participate in events to commemorate the 100th Anniversary of the Royal Canadian Navy Reserves and HMCS Carleton:

    THEREFORE BE IT RESOLVED THAT the City of Ottawa undertake the following activities to commemorate the 100th Anniversary:

    1. Freedom of the City Ceremony for HMCS Carleton in September 2023
    2. Planting small selection 100th Anniversary Royal Canadian Naval Reserve tulips in Elgin Street gardens; and
    3. Planting of a 100th Anniversary Tree in Diamond Jubilee Park in Findlay Creek.

    WHEREAS Hydro Ottawa Limited ("Hydro Ottawa") is a local distribution company that is wholly owned by the City of Ottawa; and

    WHEREAS Hydro Ottawa is a public service company and community asset whose purpose is to provide efficient and reliable services and help deliver on the City of Ottawa's economic and environmental ambitions; and

    WHEREAS Hydro Ottawa has the infrastructure, expertise, and service-delivery channels to be one of the most important enablers of sustainable energy solutions across the City of Ottawa and Eastern Ontario.

    THEREFORE BE IT RESOLVED that the City Manager and City Clerk be directed to notify Hydro Ottawa of any staff reports and/or motions being brought to City Council that may impact the City of Ottawa's electricity grid or emergency preparedness of the grid in order that it may provide meaningful guidance; and

    BE IT FURTHER RESOLVED that staff consult with Hydro Ottawa on developing projects in the City of Ottawa that may impact the electricity grid’s current and future capacity/resiliency, so that Hydro Ottawa may provide expertise and advice, subject to any restrictions contemplated by applicable competition legislation.

    WHEREAS City Council approved the new Parkland Dedication By-law (No. 2022-280) on August 31, 2022; and

    WHEREAS the By-law now requires parkland conveyance or cash-in-lieu of parkland to be provided to the City before the issuance of a building permit for a new dwelling if it cannot be demonstrated that parkland dedication has been previously satisfied in accordance with the Planning Act; and

    WHEREAS the By-law requires conveyance of parkland or cash-in-lieu of parkland at 5% of the gross land area for low density residential uses; and

    WHEREAS Subsection 3(4) of the By-law permits Council to waive parkland dedication fees;

    THEREFORE BE IT RESOLVED that City Council waive the cash-in-lieu of parkland fees required for the pending building permit at 5703 Loggers Way; and

    BE IT FURTHER RESOLVED that City Council direct Staff to review the Parkland Dedication By-law to determine whether the By-law should be amended to extend the transition clauses for rural building permits outside of Villages where lands were subdivided for individual residential lot purposes prior to the new By-law coming into force and report back to the Agriculture and Rural Affairs Committee by Q3 2024.

Would City staff please provide an update to Council on planned efforts in 2023 with respect to tree issues following the 2022 Dericho storm: 


Would staff estimate the number of trees lost on City property as a result of the storm (this includes City ROW lands on residential properties),


the number of trees and stumps that remain to be addressed (this includes City ROW lands that abut residential properties),


The specific plan to replace trees that were lost in 2022, including the number of trees to be planted in 2023, that are not part of the normal, annual tree planting program.
