REPORT RECOMMENDATION

That Council approve the Light Rail Regulatory Monitor and Compliance Officer Work Plan, attached as Document 1.

SANDY HILL HERITAGE STUDY PHASE II: DESIGNATION OF THE RUSSELL AVENUE- RANGE ROAD AND THE BESSERER- WURTEMBURG STREET PROPOSED HERITAGE CONSERVATION DISTRICTS

 

COMMITTEE RECOMMENDATION AS AMENDED
That Council:

1.         designate the Russell Avenue-Range Road Heritage Conservation District as identified in Document 2 under Section 41 of the Ontario Heritage Act;

2.         adopt the Russell Avenue-Range Road Heritage Conservation District Plan as shown in Document 3, as amended by deleting the reference to “Charlotte Street” and replacing it with “Laurier Avenue East”;

3.         amend the staff report to include a recommendation to direct staff to pass a by-law amending the Russell Avenue-Range Road Heritage Conservation District within 24 months of the issuance of all required building permits with respect to 452 and 454 Laurier Avenue East, to include the properties;

4.         designate the Besserer-Wurtemburg Heritage Conservation District as identified in Document 4 under Section 41 of the Ontario Heritage Act;

5.         adopt the Besserer-Wurtemburg Heritage Conservation District Plan as shown in Document 5; and

6.         approve the amended boundary for the Sandy Hill Cultural Heritage Character Area, as shown in Document 6 and the associated Character Area Guidelines to exclude the above noted Districts.

 

3.

ZONING BY-LAW AMENDMENT – 1132 FISHER AVENUE

 

COMMITTEE RECOMMENDATION
That Council approve an amendment to Zoning By-law 2008-250 for 1132 Fisher Avenue to permit the construction of four single-detached dwellings and three semi-detached dwellings, as detailed in Document 2.

 


 

4.

ZONING BY-LAW AMENDMENT – 403 TWEEDSMUIR AVENUE

 

COMMITTEE RECOMMENDATION
That Council approve an amendment to Zoning By-law 2008-250 for 403 Tweedsmuir Avenue to permit a six-storey mixed-use building with residential and hotel uses, as shown on Document 1 and detailed in Document 2 – Details of Recommended Zoning and Document 3 – Proposed Zoning Schedule.

 

5.

ZONING BY-LAW AMENDMENT – 541 AND 545 RIDEAU STREET

 

COMMITTEE RECOMMENDATIONS, AS AMENDED

That Council approve:

1.         an amendment to Zoning By-law 2008-250 for 541 and 545 Rideau Street to permit a nine storey mixed-use building and semi-detached dwelling, as detailed in Document 3, as amended by the following:

a.         That Document 3 be amended as follows:

i.    In Column III – Additional Land Uses Permitted, add: “semi-detached dwelling”

ii.   In Column V, add the text: “- A semi detached dwelling may only front along Cobourg Street”

b.          that, pursuant to the Planning Act, subsection 34(17), no further notice be given.

 


 

6.

ZONING BY-LAW AMENDMENT – 3443 INNES ROAD

 

COMMITTEE RECOMMENDATION, AS AMENDED

That Council approve an amendment to Zoning By-law 2008-250 for 3443 Innes Road, shown in Document 1 and detailed in Document 2, to facilitate the development of a six-storey mixed use building, as amended by the following:

1.         that a Holding provision be added to the Zoning;

2.         that Delegated Authority on the site plan be removed and that approval of the site plan require approval of Planning Committee and Council; and

3.         that no further notice be given, pursuant to subsection 34(17) of the Planning Act.

 

7.

OFFICIAL PLAN REVIEW

 

 

COMMITTEE RECOMMENDATION

That Council approve:

 

1.         that Planning, Infrastructure, and Economic Development staff begin a Comprehensive Review of the Official Plan under the Provincial Policy Statement and a conformity review under Section 26 of the Planning Act for purposes of developing a new Official Plan for the City; and

 

2.         that staff bring forward the findings of Ottawa Next: Beyond 2036 study, as directed by Motion PLC 36/7, a detailed work plan and budget for the Official Plan review at the first Planning Committee meeting of the next term of Council.

8.

ZONING BY-LAW AMENDMENT – PART OF 3640 GREENBANK ROAD

 

COMMITTEE RECOMMENDATIONS, AS AMENDED

That Council :

1.         consider this report at its meeting on 12 September 2018 pursuant to Subsection 35. (5) of Procedure By-law 2016-377, to avoid further delays in project construction; and

2.         approve an amendment to Zoning By-law 2008-250 for part of 3640 Greenbank Road to lift the holding symbol to remove the exception for the increased front yard and corner side yard setbacks and to increase the maximum permitted height for back-to-back townhouses, as detailed in Document 2.

ZONING BY-LAW AMENDMENT – ANOMALY – 25 EDGEWATER STREET

 

COMMITTEE RECOMMENDATIONS

That Council:

1.         consider this report at its meeting on September 12, 2018, pursuant to Sub-Section 35(5) of the Procedure By-law; and

2.         approve a technical amendment to Zoning By-law 2008-250 to carry forward the regulations of the former Kanata Zoning By-law to accurately harmonize those regulations for the lands municipally known as 25 Edgewater Street, by rezoning them from IG2[1534] to IG2[XXXX], as detailed in Document 2.

COMMITTEE RECOMMENDATION
That Council approve an amendment to Zoning By-law 2008-250 for 2548 8th Line Road to permit a village residential Plan of Subdivision, as detailed in Document 3.

 

B.

PROVINCIAL SEVERANCE REQUEST – 4649 AND 5370 HALL ROAD, 9045 MITCH OWENS ROAD, 5400, 5420, 5785, 5817 AND 5901 THUNDER ROAD

 

COMMITTEE RECOMMENDATION
That Council amend the delegated authority by-law to authorize the Director of Planning Services to support the exemption requested by the Province from Section 53(3) of the Planning Act, which pertains to the consent to sever land as drafted in Document 3.

BUCKLES MUNICIPAL DRAIN – APPOINTMENT OF ENGINEER

 

COMMITTEE RECOMMENDATION
That Council proceed with the drainage works and appoint Andy Robinson, P. Eng of Robinson Consultants Inc. as the Engineer of record to prepare a report under Section 78 (1) of the Drainage Act to inform Council on the current status of the Buckles Municipal Drain and whether one or more of the projects listed under Section 78 (1.1) is required for the better use, maintenance or repair of the drainage works or lands or roads.

BRANCH 4, WILSON-JOHNSTON MUNICIPAL DRAIN PETITION – APPOINTMENT OF ENGINEER

 

COMMITTEE RECOMMENDATION
That Council proceed with the drainage works and appoint Mr. Andy Robinson, P. Eng of Robinson Consultants Inc. as the Engineer of record to prepare a report under Section 8 of the Drainage Act in response to a petition received under Section 4 of the Drainage Act, as described in this report.

ZONING BY-LAW AMENDMENT – 605 LONGFIELDS DRIVE

 

COMMITTEE RECOMMENDATION
That Council approve an amendment to Zoning By-law 2008-250 for 605 Longfields Drive to rezone the lands to Mixed-Use Centre Zone with site-specific provisions to allow the development of a one-storey commercial development, as detailed in Document 2.

OFFICIAL PLAN AMENDMENT - 4747, 4755, 4789, 4791 AND 4840 BANK STREET, LEITRIM COMMUNITY

 

COMMITTEE RECOMMENDATION
That Council approve Official Plan Amendment No. XX of the City of Ottawa Official Plan, as detailed in Document 2.

CASH IN LIEU OF PARKLAND – 565 WEST HUNT CLUB ROAD

 

COMMITTEE RECOMMENDATION
That Council approve a cash in lieu of parkland credit of $100,000.00, $70,000.00 of which it is to be attributed to application D07-12-18-0093, or the subject property, 565 West Hunt Club Road, and the remaining $30,000.00 credit to be utilized for future development at this site.

WHEREAS 8609454 Canada Inc. (Brigil) entered into a deferral agreement for development charges, registered as Instrument No. OC1975755 on March 1, 2018; and

WHEREAS on April 26, 2018, Building Code Services issued a building permit to 8609454 Canada Inc. for the construction of a foundation and six levels of underground parking in respect of the property known municipally as 121 Parkdale Avenue; and

WHEREAS the Director of Titles for the Province of Ontario did not certify such agreement and therefore removed the instrument from the title of the property known municipally as 121 Parkdale Avenue; and

WHEREAS 8609454 Canada Inc. and the City entered into the agreement in good faith for the purpose of deferring the payment of development charges; and

WHEREAS 8609454 Canada Inc. intends to pay their development charges at the issuance of their next building permit for the aforementioned property;

BE IT RESOLVED that Council approve that 860954 Canada Inc. be permitted to pay their development charges at the rate in place for April 26, 2018, as long as the next building permit is issued prior to December 31, 2018 and with adherence to all clauses within the executed deferral agreement, including interest.

 

The Fleury/ Leiper Motion, of which notice was given at the City Council meeting of August 29, 2018, has been withdrawn pursuant to Subsection 60(6) of the Procedure By-law.
